Liberty is one of the guaranteed right of a person embodied in the 1987 Philippine Constitution. It is one of the reasons why the fundamental law of our land was drafted and existing until now.
Due to the obvious disregard of a person's right to freedom from restraint during those early days of our established government, the rule on Arrest was included by the framers of constitution to the Bill of Rights article. This truly emphasizes that indeed, this rule on arrest really belongs to a person as one of his fundamental right.
But, enjoying rights somehow creates abuse on the part of others who are although living with the rights that they deserve as a person, also disrespects others rights to live with it. They are those offenders of the law. Thus, the rules were interpreted to resolve these abuses.
Warrantless arrest and citizen's arrest are one of those exceptions to the enjoyment of one's right over freedom from restraint.
